Introduction:-
According to the Oxford Dictionary of
English, 'Reservation means "being reserved The Indian law provides for a
quota system, where a percentage of posts are reserved in employment in
Government and private sectors, in all private and public sector institutions
and also in Parliament in order to mitigate backwardness of the socially
backward communities and scheduled castes and tribes.
Criteria of reservation:-
For claiming reservation, various
criterias are laid down. The first is based on caste system. The major
proportion of reservation is given to scheduled castes and scheduled tribes.
Similarly, reservation can be gender based, in which women are given
reservation. Religion, place of birth, relative of a freedom fighter,
physically handicapped, sports personalities, non residential Indians,
ex-serviceman, senior citizens and legal heirs of armed-forces personnel killed
on action can claim reservation.
There are also controversies regarding
reservation for example- the women reservation and the reservation for OBC. As
per the Reservation Policy of India, Women get 33% reservation in gram
panchayat and municipal elections. There is a long term plan to extend it to
Parliament and Legislative assemblies.
In spite of all these controversies,
Tripura has an exceptional and remarkable record of accepting a 50% reservation
for women without in village and panchayat levels.
Demerits of reservation:-
Reservation creates deep resentment in
higher classes. Allocating quota is a form of discrimination which is contrary
to right to equality. The main problem regarding this reservation is that the
backward classes who enjoy reservation enjoys for ever but the backward classes
who fail to enjoy, fails forever. Such type of ever enjoying classes are called
creamy layer and because of them people are getting resented to the reservation
policy.
Solution:-
The Judiciary and Government of India
has laid down various guidelines, time to time for the purpose of solving the
problem regarding reservation.
In Indra Sawhney v/s Union of India,
the hon'ble Supreme Court laid down some criterias through the Mandal
Commission, which is to be followed in the field of reservation.
Conclusion:-
Amidst various activities initiated by
the Judiciary and Government of India, the reservation policy adopted in India
has not been totally succeeded in promoting social justice. The implementation
of Mandal Commission reports saw wide spread riots across India. The decision
of Government to give 27% reservation for the OBCs has further strengthened the
existing caste distribution. Specially the medical students strongly protested
the decision.
The question being raised is that why
should some persons be denied the rewards of hard work, skill and the requisite
qualifications, just because of his or her high birth? Hence, confusion arises,
will reservation of quotas solve the problem?
