FEATURES OF THE PROTECTION OF HUMAN RIGHTS ACT, 1993:
The
Act come into force on the 28th day of September, 1993 and extends to
whole of India. The Act has been framed with the object to provide for the
constitution of a National Human Rights Commission, State Human Rights
Commissions in States and Human Rights Courts for better protection of human
rights and for matters connected therewith or incidental thereto. It has contained
the following key features.
- The Act gives the meaning of Human Rights.
- The Act provides provisions to defend people from being violated in their rights. The constitutionally guaranteed rights to life, liberty, equality, and dignity are referred to as "Human Rights."
- The Act contains provisions for protect all the rights from abuses of power committed by intervention of the state action.
- It also provisions for necessary and efficient steps for obtaining redress in the event of a violation of rights.
- It owes for
investigation team for purposes of investigation and
prosecution of offences arising out of violations of human rights.
- The most important feature of the Act is that it constitutes the National Human Right Commission, State Human Rights Commissions, and Human Rights Courts to stop and prosecute serious violations of human rights.
Human
rights are the inalienable rights of man, the protection of which is the
primary responsibility of the state.
